If you do not agree to these Terms, you may not access or use our services. By using our services, you affirm that you are at least 18 years old and have the legal capacity to enter into this agreement.

1. Description of Services

DroneServiceToday.com operates a platform that connects customers with licensed and certified drone pilots ("Pilots") for various commercial drone services including, but not limited to:

  • Agricultural monitoring and analysis
  • Emergency response and disaster assessment
  • Infrastructure and powerline inspection
  • Roof and property inspection
  • Livestock monitoring and management
  • Compliance and safety certification services
  • Other drone-related services as offered on our Platform

We act as an intermediary between Customers and Pilots. We do not directly provide drone services but facilitate the booking and coordination of such services through our network of independent Pilots.

2. Account Registration and Requirements

To access certain features of our Services, you may be required to create an account. When you create an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

You must be at least 18 years old to create an account. We reserve the right to suspend or terminate accounts that violate these Terms or applicable laws.

3. Booking and Payment Terms

3.1 Service Booking

When you book a service through our Platform, you are making a request for drone services from an independent Pilot. Bookings are subject to Pilot availability and confirmation. We will notify you once a Pilot has been matched and confirmed.

3.2 Pricing and Fees

All prices displayed on our Platform are in US Dollars (USD) and may include applicable taxes. Prices may vary based on service type, location, and complexity. We reserve the right to change pricing at any time, but changes will not affect confirmed bookings.

3.3 Payment

Payment is processed securely through our Platform. By providing payment information, you authorize us to charge the applicable fees for your booked services. Refunds are subject to our Cancellation Policy.

3.4 Cancellations

  • Full refund for cancellations made 48+ hours before the scheduled service
  • 50% refund for cancellations made 24-48 hours before the scheduled service
  • No refund for cancellations made less than 24 hours before the scheduled service
  • Emergency service cancellations may be handled on a case-by-case basis

4. User Conduct and Responsibilities

When using our Services, you agree NOT to:

  • Use our Services for any illegal or unauthorized purpose
  • Violate any laws in your jurisdiction
  • Interfere with or disrupt our Platform or servers
  • Attempt to gain unauthorized access to any accounts or systems
  • Use automated tools to access our Platform without permission
  • Harass, abuse, or harm other users, Pilots, or our employees
  • Submit false, misleading, or fraudulent information
  • Infringe on intellectual property rights of others

You are responsible for ensuring that the location where services are to be performed is accessible and safe for drone operations. You must obtain any necessary permissions or consents required for Pilots to access your property.

5. Limitation of Liability and Disclaimers

5.1 Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that: (a) our Services will be uninterrupted, secure, or error-free; (b) the results obtained from our Services will be accurate or reliable; (c) the quality of any services will meet your expectations.

5.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRONESERVICETODAY.COM AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

5.3 Third-Party Services

Our Services may include links to third-party websites or services that are not owned or controlled by us. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

6. Pilot Responsibilities and Independent Contractors

All Pilots available through our Platform are independent contractors and are not employees, agents, or representatives of DroneServiceToday.com. We do not control the methods, means, or details of the services provided by Pilots.

Pilots are required to:

  • Maintain valid FAA Part 107 certification or applicable local equivalent
  • Carry adequate commercial liability insurance
  • Comply with all applicable laws and regulations
  • Follow safety protocols and best practices
  • Provide services in a professional and workmanlike manner
  • Obtain necessary permissions for operations

While we vet Pilots before allowing them on our Platform, we cannot guarantee the ongoing compliance or performance of any Pilot. Any issues or disputes regarding services provided by Pilots should be reported to us, and we will work to resolve the matter.

7. Intellectual Property Rights

7.1 Our Intellectual Property

All content, features, and functionality of our Platform, including but not limited to text, graphics, logos, images, software, and code, are owned by DroneServiceToday.com and are protected by copyright, trademark, and other intellectual property laws.

You may not:

  • Copy, modify, or distribute our content without permission
  • Use our trademarks or logos without authorization
  • Reverse engineer or decompile our software
  • Remove any copyright or proprietary notices

7.2 Customer Content

You retain ownership of any content you submit to our Platform, such as photos, videos, or other materials ("Customer Content"). By submitting Customer Content, you grant us a non-exclusive, royalty-free, transferable license to use, reproduce, and display such content for the purpose of providing our Services.

7.3 Service Deliverables

Any data, imagery, reports, or other deliverables provided by Pilots ("Service Deliverables") are subject to the terms agreed upon between you and the specific Pilot. We do not claim ownership of Service Deliverables unless otherwise specified in writing.

8. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using our Services, you consent to the collection and use of your information as described in our Privacy Policy. You acknowledge that drone operations may capture imagery of properties and individuals, and you are responsible for obtaining any necessary consents for such captures.

We may use service providers to help operate our Platform and Services. These providers have access to your information only to perform tasks on our behalf and are obligated not to disclose or use it for any other purpose.

9. Indemnification

You agree to indemnify, defend, and hold harmless DroneServiceToday.com, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

  • Your access to or use of our Services
  • Your violation of these Terms
  • Your violation of any rights of a third party
  • Your negligent or wrongful conduct
  • Any content you submit to our Platform

10. Termination

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

Upon termination:

  • Your right to use the Services will cease immediately
  • We may deactivate or delete your account
  • Any pending bookings may be cancelled without refund
  • Provisions that should survive termination will remain in effect

You may also terminate your account at any time by contacting us or using the account deletion features in your account settings. Termination does not relieve you of any obligations to pay fees for services already rendered.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our Platform and updating the "Last Updated" date. Your continued use of our Services after such modifications constitutes your acceptance of the updated Terms.

We encourage you to review these Terms periodically for any changes. If you do not agree to the modified Terms, you should discontinue using our Services.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, United States, without regard to its conflict of law provisions.

Any dispute arising from or relating to the subject matter of these Terms shall first be attempted to be resolved through good-faith negotiations. If the dispute cannot be resolved through negotiations within 30 days, either party may pursue other legal remedies available.

You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located within Hennepin County, Minnesota for the resolution of any disputes arising from these Terms or your use of our Services.
